Last week, I researched the basics of damage caps in regards to medical malpractice cases. As a result, I wondered what other types of malpractice reform solutions have been implemented or proposed. This week I delved into some of those reforms. Apart from damage caps, one solution really stood out to me - several liability.
According to the article I read this week, “Medical Malpractice Liability Reform- No Easy Task,” several liability states that all parties in a suit are responsible for the total damages. Meaning, if one party can’t pay the full amount of their share, the other parties have to make up the difference. The article introduced proponents of this type of reform as well as critics. Overall, I learned that malpractice reform is a controversial topic. There are multiple different perspectives in response to the “medical malpractice crisis” happening in the United States.
This week, I narrowed my topic of study even further. I want to research medical malpractice reform solutions and the effects of said solutions on patients, attorneys, and the world in general. I am excited to look into more perspectives on the ethics and legality of malpractice reform. Next week specifically, I want to learn more about several liability and the effects it has in the legal world.
